1. Acceptance of Terms

By purchasing a Niche Beauty Membership, you ("the Member") confirm that you have read, understood, and agreed to these Terms and Conditions. Payment of the membership fee forms a legally binding agreement between the Member and Niche Beauty.

 

2. Membership Eligibility & Ownership

•   Personal Use Only: Memberships are non-transferable and may only be used by the individual who purchased the membership.
•   Verification: Niche Beauty may request identification to confirm membership status before applying discounts.
•   Age Requirement: Members must be 18 or over unless accompanied by a parent/ guardian.

 

3. Membership Fees & Duration

•   Initial Term: £60 for the first six (6) months.
•   Subsequent Term: £40 for the following six (6) months.
•   Annual Reset: After 12 months, the membership resets to the initial £60 rate for the first six months and £40 for the next six.
•   Activation Date: Membership begins on the date full payment is received.
  Start dates cannot be chosen or delayed to coincide with a future booking.
•   Non-Refundable: Membership fees are non-refundable once the membership period has begun (UK consumer Law for ongoing service contracts).

 

4. Booking & Attendance Rules

4.1 Monthly Attendance Requirement

• All treatments must be booked and attended within the same calendar month.

4.2 Multi-Service Treatments (Dual/ Triple Services)

•   If a treatment includes two or three services within the same month:
•   All services must be completed within that month.
•   If the Member misses one service, they may pay a voluntary £10
• extension fee to attend the final
  service within the first week of the following month.

4.3 Forfeiture

•   If a Member does not attend the service within the month and does not pay the £10
  extension fee:
  The missed service is cancelled.
•   Cancelled services are non-refundable and cannot be
  rescheduled.

4.4 Fairness Notice (UK Law)

Niche Beauty will always act reasonably and may waive fees or offer alternative solutions in exceptional circumstances (e.g., medical emergencies). Compliance with the Consumer Rights Act 2015.

 

5. Pricing & Payment Terms

5.1 Multi-Service Treatments

•   Treatments that include two or three services must be paid in full at the first appointment.
•   Split payments (e.g. paying half at each visit) are not accepted.

5.2 Single-Service Treatments

• Payment may be made immediately before or after the appointment.

5.3 Transparency

• All prices are displayed clearly and comply with Dudley Trading Standards requirements.

 

6. Cancellation & Refund Policy

6.1 Single-Service Treatments

• Refunds are available only if requested before the service is attended.

6.2 Multi-Service Treatments

• Refunds are available only before the first service of the treatment bundle has been attended.
• Once the first service has been completed, the remaining services are non-refundable.

6.3 Membership Fees

• Membership fees (initial or renewal) are non-refundable once the membership period has started.
• This complies with UK Law for fixed-term service memberships, provided the terms are clearly disclosed.

 

7. Appointment Cancellations & No-Shows (UK Trading Standards)

•   Members must follow Niche Beauty's standard cancellation policy for all appointments.
•   Late cancellations or no-shows may result in charges in line with the salon's published policy.
•   Repeated no-shows may result in suspension of membership benefits.

 

8. Fair Use & Misuse

•   Membership discounts must not be abused or used to book treatments for others.
•   Any misuse may result in suspension or termination of membership without refund.

 

9. Data Protection (GDPR Compliance)

•   Niche Beauty will only use your personal data for booking, membership administration, and communication related to your treatments.
•   Your data will be stored securely and never shared with third parties without your consent, except where legally required.

 

10. Changes to Terms

•   Niche Beauty may update these Terms & Conditions when necessary (e.g., legal changes, business updates).
•   Members will be notified in advance of any significant changes.

 

11. Governing Law

These Terms & Conditions are governed by the Laws of England and Wales.

Any disputes will fall under the jurisdiction of UK courts.

 

Membership Card Policy

1. Issuing the Membership Card

Upon activation of the membership, Niche Beauty will issue the Member an official Membership Card. The card will display the Member's full name, contact number, membership start date & end date and a unique identification code.

As part of the verification process, a photograph of the Member holding their Membership Card will be taken at the time of issue. This photograph is used solely for identity confirmation and to prevent misuse of membership benefits.

 

2. Use of the Card

The Membership Card must be presented at appointments in order to access membership discounts and benefits.

Niche Beauty reserves the right to request identification to confirm that the card is being used by the correct Member.

The card remains the property of Niche Beauty and must not be altered, shared, lent, or used by any individual other than the named Member.

 

3. Replacement Cards

Each Member is entitled to two (2) complimentary replacement cards within each six-month membership period.

Any additional replacement cards requested within the same six-month period will incur a £5 replacement fee.

Replacement cards will be issued with a new unique identification code for security purposes, and Niche Beauty may take an updated verification photograph if required.

 

4. Loss, Theft or Misuse

The Member must notify Niche Beauty immediately if their card is lost, stolen, or damaged.

Niche Beauty is not responsible for any misuse of the card prior to the Member reporting it as lost or stolen.

Any misuse of a Membership Card - including use by another person - may result in suspension or termination of membership benefits without refund.

 

5. Signature Requirement

Each Membership Card includes a designated signature box. The Member is required to sign this box to confirm that they have read, understood and agreed to the full with the Niche Beauty Membership Terms & Conditions.

5.1 Confirmation Prior to Signing
Before the Member signs the Membership Card, they will be asked to confirm whether they have read the full Terms & Conditions.

•   If the Member has already read the Terms & Conditions, they may proceed to sign the card.
•   If the Member has not yet read the Terms & Conditions, they will be provided with a copy (if available) or directed to access the Terms & Conditions online before signing.

5.2 Access to Terms & Conditions
Niche Beauty will make reasonable efforts to provide a physical copy of the Terms & Conditions when requested.
If a physical copy is not available at that moment, the Member will be advised to read the Terms & Conditions online and return to purchase the membership once they have done so.

5.3 Refusal of Membership if the Member :

•   refuses to read the Terms & Conditions
•   is unable or unwilling to access the Terms & Conditions online or declines to sign the Membership Card confirming their agreement, Niche Beauty reserves the right to refuse the sale of the membership until the Terms & Conditions have been properly reviewed and acknowledged.

 

6. Legal Responsibility

It is the Member's legal responsibility to read and understand the full Terms & Conditions before signing. The Member's signature on the Membership Card serves as formal confirmation of their acceptance of the agreement.
